1. Who we are

This website (alexonthebeach.com) and its online booking and payment services are operated by Red Cloud LLC, a limited liability company organized under the laws of the State of Arkansas, United States(“Red Cloud,” “we,” “us,” or “our”). “Alex on the Beach” is a brand operated by Red Cloud under license.

Red Cloud LLC is the seller and merchant of recordfor bookings and payments made through this website. The tours, excursions, and activities themselves (the “Tours”) are performed by our independent local operating partner in Guanacaste, Costa Rica (the “Local Operator”), which is licensed and insured to provide Tours under the laws of Costa Rica.

2. Acceptance of these terms

By accessing this website, booking a Tour, or communicating with us (including by WhatsApp), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use this website or book a Tour.

3. Bookings

  • A booking is a request to purchase a Tour and is confirmed only when you receive a booking confirmation from us (by email or WhatsApp).
  • You are responsible for providing accurate booking details (names, dates, party size, contact information, and pickup location).
  • Tour availability, inclusions, and meeting points are as described at the time of booking.

4. Prices and payment

  • Prices are shown in US dollars (USD) unless stated otherwise and include the items listed in the Tour description.
  • Payment is collected by Red Cloud LLC through a third-party payment processor. “RED CLOUD LLC” (or a similar descriptor) will appear on your card or bank statement.
  • Full payment or a deposit may be required to confirm a booking, as indicated at checkout.

5. Changes, cancellations, and refunds

  • Cancellations made at least 48 hours before the Tour start time are eligible for a full refund.
  • Cancellations within 48 hours of the start time are eligible for rescheduling only and are non-refundable.
  • We or the Local Operator may cancel or reschedule a Tour for safety, weather, or operational reasons; in that case you may choose a reschedule or a full refund.
  • Refunds are issued to the original payment method by Red Cloud LLC.

6. The Tour experience

  • Tours are delivered by the Local Operator in Costa Rica, which is responsible for the on-the-ground conduct, safety, licensing, and insurance of the Tours.
  • You are responsible for arriving on time at the agreed meeting point, disclosing relevant health or medical conditions, and following the guide's safety instructions.
  • Some Tours involve physical activity and inherent risks (water, boats, wildlife, terrain). You participate voluntarily and assume these ordinary risks. The Local Operator may require you to sign a waiver on site.

7. Limitation of liability

  • Red Cloud LLC provides the website, booking, and payment platform and acts as seller of record. To the fullest extent permitted by law, Red Cloud LLC is not liable for personal injury, loss, or damage arising from the physical performance of a Tour, which is the responsibility of the Local Operator.
  • To the fullest extent permitted by law, Red Cloud LLC's total liability for any claim relating to a booking is limited to the amount you paid for that booking.
  • Nothing in these terms limits any liability that cannot be limited under applicable law.

8. Communications and WhatsApp

  • By providing your phone number or messaging us on WhatsApp, you consent to receive booking-related (utility) messages such as confirmations and reminders.
  • You may separately opt in to promotional messages and can opt out at any time by replying STOP or contacting us.
  • Message and data rates may apply. See our Privacy Policy for how we handle messaging data.

9. Intellectual property

The “Alex on the Beach” name, logos, and website content are owned or licensed by Red Cloud LLC and may not be used without permission.

10. Governing law

These terms are governed by the laws of the State of Arkansas, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Benton County, Arkansas, and you consent to that jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your place of residence.

11. Changes to these terms

We may update these terms from time to time. The version posted on this website with the most recent effective date applies to your booking.
